If I buy marijuana legally in Maryland and bring it back to Pennsylvania, can I get in trouble?

Recently, our neighbors to the south voted to legalize recreational marijuana. While the new measures do not go into effect until July 2023, people already have a lot of questions.

Once marijuana does become legal in Maryland, it gives many Pennsylvanians the opportunity to drive across the Mason-Dixon line and legally purchase cannabis and related products. But just because it is legal in MD, does not make it legal to possess and use in PA. So yes, it is illegal and you can get into trouble.

How much trouble can I get in?

Many prosecutors won’t pursue charges for simple possession of a small amount of marijuana under 30 grams, but that is no guarantee. Plus, there are still cops out there who will arrest you for possession and that in and of itself is a punishment.

If you have more than 30g, then the penalties increase and you could face up to a year in prison and up to $5,000 in fines. Also if you are convicted of marijuana possession it can trigger a six month license suspension.

What if I tell the police everything including that I was going to share it with a buddy?

Let’s say you wanted to be “the guy” and bring back cannabis for a bunch of friends. While you wanted to score brownie points, you could be charged with a felony. In this scenario, police can charge you with Possession with Intent to

Deliver which is a felony that carries up to 5 years in prison.
