Will simply being charged with a DUI ruin my life (even if I am found later found not guilty)?

When folks say “it’s only a DUI”, I laugh at them. The modern day scarlet letter is a DUI conviction. If you are found guilty or admit guilt of a DUI charge, it stays on your record forever. Anyone with a phone or a computer with an internet connection can find out someone’s open charges or their convictions. Don’t believe me? Go the Pennsylvania Web docket system by clicking this link: Magisterial District Courts if you have been charged with a DUI or any traffic or criminal defense, it’s all there.

Saying “it’s only a DUI” is just infuriating. It is so much more than that. It is about keeping everything you have built up in your life to this point and future proofing you legacy so your nest days remain in front of you. DUI cases in PA can be won. If we win, then these records on the internet can be ordered removed. We here at The McSHANE FIRM are your ferocious and fearless fighters. Consider this nod from one of our colleagues:

I honestly refer to Justin McShane as the Yoda of the DWI world. This guy knows it all and teaches other lawyers around the Nation to be Jedi warriors in DUI defense and the science that accompanies it.

Justin has honestly pushed the limits and brought scientific training to the forefront for attorneys like no one else has ever. He was one of the original lawyer students at Axion Labs and now is an instructor with his wife at Axion Labs. He is responsible for teaching hundreds of lawyers the intricate science and the natural flaws and how to spot that for lawyers. Accordingly, through his teachings, lawyers have gone out and saved countless futures, careers and even lives.

Justin is not only respected by fellow lawyers and judges but he is also respected in the scientific community. He was the first criminal defense lawyer to ever be invited to speak at the Borkenstein School at University of Indiana which specifically prohibits criminal defense lawyers from attending. He has also been asked to speak to the American Chemical Society. That based on being a tremendous trial lawyer are unbeatable.

I think he only takes the toughest cases in the Nation now. If you can afford him and he will agree to represent you, you could do no better in the entire Nation. He is simply the best around. If I ever got arrested, and my life and career was on the line, I would pay anything to fly him in and handle my case. He’s who you call when it’s all on the line and you can’t afford to lose.

As a side note: this guy is the real deal too. He’s a warrior inside and outside the court room. He can back it up anytime, anywhere, with anyone.

What are the DUI penalties in Pennsylvania?

The answer that no one likes to hear applies: “It depends.” But it depends not simply based upon your prior record, your prior driving history and the facts of your case. Those things do matter as you can read more about here:

But what truly matters most in your DUI case is who your lawyer is. Fact.

Really…. how many times do attorneys actually win DUI cases? Why even put on a DUI defense?

Sometimes we hear from potential new clients something along the lines of:

  • “I talked to the officer. He said no one ever wins a DUI case. So, I might as well plead guilty.”
  • “I talked to my brother’s friend who is a real estate attorney. He says no one ever wins DUI cases. He’s never seen it. So, I shouldn’t waste my money on an attorney. “

Here’s a simple life tip. If you feel that it is in your best interest to take your legal advice from the guy who arrested you or your brother’s friend who does paperwork for a living…

Why not scroll through any number of testimonials from real life people that have left us reviews that prove that officer and that paperwork lawyer are just bonkers. Here’s one for you to consider:

Attorney Justin McShane and his team fought the fight for me and never gave up…. It was quite the battle, but his impeccable representation and performance rendered justice. I was cleared of all charges and am so thrilled to be moving on with my life!

Have you ever made a mistake? Have you ever had life situations that you reacted to incorrectly and didn’t make the best choices afterwards? Unfortunately I have. Sometimes life doesn’t go your way and you make bad choices. This could be a career ending event. i was lucky enough to find Tim Barrouk. As a company executive, a dui could have been the end of my career. I’m embarrassed for the choices I made but the law doesn’t care about that. Tim Barrouk does. Tim fought for me to the highest degree. He never once judged me on the charges, but always looked at how he could best help me get through my mistakes. While it was a long and exhausting battle. Tim, was without a doubt the best attorney to fight for me. Thanks to Tim, I’m Still a senior level ranking executive at a major corporation. Without Tim working his magic and using his knowledge to clear my name, I wouldn’t be were I am. As a sole income earner and father of two, Tim’s results have truly saved my life. When I got arrested , I thought that was it. I’m done. My wife will divorce me. I’ll never get back to my level of work. It’s over. Tim kept me encouraged and I can’t thank him enough. Because his hard work has helped me be where I am today. A DUI isn’t the end of your life if you learn from it and have the right attorney. I make nearly 3x as much money as I did just 5 years ago. And for you Executives that want to put that into perspective. I was making 110k when I got my DUI . I make nearly 350k now. Mistakes can be forgiven IF you have the right representation. Will a DUI charge affect my security clearance?

Probably. As you know your security clearance comes to you after an investigation of your background. As you likely know, your security level is reviewed time to time. Here’s some information on security clearances from our government: Background Checks and Security Clearances for Federal Jobs. Sometimes it is an automated check of your criminal and driving history where the new pending charge of DUI will show up. Your general character and fitness is always an issue. To keep your Top Secret, Secret or Confidential security clearances, you need the PA DUI lawyers who won’t quit on you. That’s us.

Can a DUI be expunged?

Here’s some information on the difference between pardons, expungments and limited access orders in PA and who can get them: How can I clear my record in Pennsylvania?

I hit something and now am charged with a DUI accident. It’s all over, right?

We get a lot of cases where folks have the worst luck. DUI defense is often about meeting folks while they are undergoing the pain and shame of their worst moment in life. We get that. No judgments. Most of the time, we hear about other cars hitting our client’s car. But when the police arrive, even though it’s clearly the other person’s fault, our client gets arrested for DUI. That just isn’t fair. Whether you hit something or someone a DUI charge is real serious business. Every single prosecutor seeks to “enhance” the penalty (ask for worse punishment) if there is any form of injury or property damage. When you are in that type of spot, you need to get the best DUI attorneys on your side NOW.

What to expect with a DUI charge? What is DUI defense like in Pennsylvania?

It’s the court process. It is large. It is inefficient. You have to get your mind around a couple of immutable facts:

  1. This is not going to go away on its own.
  2. There are going to be good days and bad days in dealing with this. One thing is for certain, it is going to take many days.
  3. The government is trying to put you in jail, end your career, brand you as a criminal for the rest of your days and put you in financial jeopardy.
  4. Who your attorney is makes the difference. DUI defense is a highly specialized area of the law. Don’t put an amateur or an inexperienced attorney in charge of your DUI defense.

Let’s try to keep your name out of the paper.
They put my name in the paper for a DUI arrest. Can’t I sue them?

No. The First Amendment gives us freedom of the press. We think that for every article like this one:

These people were charged with crimes yesterday in central Pennsylvania

There ought to be one article that prints the people who were found not guilty of a crime or had the charges reduced or dismissed. Sadly, those types of articles are rare.

How can I lessen the DUI charges in Pennsylvania?

There’s all sorts of sayings that apply here:

  • Good lawyers aren’t cheap. Cheap lawyers aren’t good
  • If you think that going with a pro is expensive, try going without a pro

The truth is the single biggest outcome to your DUI case is your DUI lawyer. Pick the wrong one and the consequences for a DUI can follow you for life. You need the best DUI lawyer in PA:

Does this sound like you or something that could happen to you?

Last night was a catastrophe. This morning is torture. It feels great to have friends who want to spend time with me. The day was over. I was tired. All I really wanted to do was to….. go home. Yup, it was a long day and what seemed like a forever week. Work. Stress. Work. Stress. Work. Stress. Out of the clear blue, I got a text from a friend I hadn’t seen in a while. She said that she was in town for the night. Did I want to catch up on old times. Well, heckfire yes I did. I texted her back. She said “bring me some stories about your life since the last time I saw you.” I agreed.

The day couldn’t end fast enough. You know one of those where the minutes felt like hours? But I triumphed. I finished the day. I went to the restaurant to meet my friend. Not surprisingly, she was not on time. So, I decided rather than just sit like a weirdo and stare at my phone, I would have one drink. That’s it. Just nurse the thing. Just one.

A couple of minutes later, there she was all smiles. I was so happy to see my old friend that I didn’t mind her being late or being so dead dog on tired. We asked for a table. We got down to our “business”: like the country song goes: “Were having us some beers and / Swapping I don’t cares / Talking politics / Blonde and red-haired chicks / Old dogs and new tricks” All was grand.

Next thing I know, the gang from work came barreling in the restaurant and bar. They were out and about. I didn’t usually join them. But tonight they were so shocked to see me, they just wouldn’t let us go. They were downing the drinks. I was not. Knowing I had to drive home, I was pacing myself. Finally, after several hours of constantly trying to pry myself out of the group, I found my jaw’s of life like moment and escaped.

I got to my car. By text, I explained to her that I was sorry that my work gang barged in, but it sure was nice to see her. Just as I was hitting the send button, the dark night sky was flooded with piercing red and blue lights. The road isn’t perfectly straight there. I was being stopped. Maybe in my texting moment, I didn’t keep that perfect lane. I’ll apologize for texting while driving and likely get a warning. I have nothing to worry about, I said to myself. I only had a few. But remember when good ol’ sloppy Bill spilled his drink on my pants…. ot oh. I smell like a brewery. Suddenly, my optimism turned.

Next thing I knew I was being in handcuffs. Wow. What do I do now that I have a DUI charge?

And what makes it worse? I didn’t even want to go out. Is there DUI defense? Does anyone know any good PA DUI Lawyers?

What to do When Faced with Arrests and DUI Charges in Pennsylvania

First and foremost, call right away. Don’t panic. There are usually many options. However, depending on your circumstance and your charges, you may have a specific time to respond. Whenever there is an arrest, time is of the essence. Anyone arrested has certain constitutional rights that attach at the time of arrest that need to be asserted right away to protect you, your friend or family member. Our toll free service is available 24 hours a day, and we are ready to immediately respond to your crises. We work with you to obtain bail through appearing before the Judge for preliminary arraignment and help in organizing the posting of property, cash percentage or a bail bondsman.

If you are charged with drunk driving in Pennsylvania you have a right to fight DUI and we can help. Let The McShane Firm examine and possibly challenge the following:

  • The reasonable and articulable suspicion for the vehicle stop.
  • The questioning of you at the roadside or afterwards.
  • The Pre-Arrest Breath Test.
  • The Standard Field Sobriety Tests.
  • The probable cause for the arrest.
  • The Breath test and Blood test result themselves. **
  •  The possible PennDOT suspension of your license.

** For Breath and Blood tests, challenges can be made to keep them out of evidence based on previously known equipment malfunctions. In the case of a Breath Test, we can challenge the maintenance, calibration and use of the Intoxilizer 5000 or BAC Datamaster, and examine an argument against the admission of the result into evidence. In the case of a Blood Test, we challenge and look into possible 4th Amendment violations in the officer’s or trooper’s securing of your blood sample and to challenge the collection and subsequent analysis of the blood specimen. Likewise, possible 4th Amendment violations can constitute a basis for refusing to provide a blood sample. Many Breath and Blood Test results are inaccurate due to improper equipment and a number of cases have been thrown out or reduced due to improper equipment, without the help of The McShane Firm, this challenge of evidence could be overlooked. PA DUI Info is hard to come by. We write books on it. Judges, lawyers and prosecutors all stop to listen to us when we share our PA DUI Info.

The McShane Firm can Help Your DUI Case at Your Preliminary Hearing

A preliminary hearing of a DUI or drunk driving case is where a lot of charge bargaining occurs, such as reduction, amendment or the withdrawal of charges. While a preliminary DUI or drunk driving hearing is technically about whether or not the Commonwealth can meet its burden of prima facia before a Magisterial District Judge, the true purpose of this hearing is three fold.

  • First, The McShane Firm can present the case in such a way that all, or some, of the charges are dismissed because there is a lack of competent evidence to sustain the Commonwealth’s burden.
  • Second, it ‘locks’ the testifying witnesses into their stories so that if they change their stories or lie about the situation later on, they can be impeached with their prior inconsistent statement.
  • Third, it establishes and develops potential suppression issues or allows you to preliminarily explore the type and quality of evidence against you.

Due to the importance of these three aspects, a preliminary hearing is crucial to your case, and without proper representation, you make it easier to convict you of your DUI or drunk driving case. Even if you feel that you are guilty, an attorney can still achieve some benefits for you for giving up your right to a preliminary hearing. Let The McShane Firm help you with your DUI or drunk driving case and help you avoid going to jail or having to surrender your driver’s license.

When you go to ask the qualifications of the PA DUI attorney who you are going to trust with your life and your driver’s license, ask whoever it is the following Checklist questions:
