If you’ve ever been charged with DUI in Pennsylvania — especially in Dauphin County — there’s a major legal shift you need to know about. Two recent decisions from the Pennsylvania Supreme Court have changed how DUI cases are handled, and the impact is huge for anyone hoping to avoid harsh penalties.
In the case of Commonwealth v. Shifflett, the Court ruled that ARD — the Accelerated Rehabilitative Disposition program — cannot be counted as a prior offense for sentencing in a later DUI case. That’s a big deal. It means if your first DUI was resolved through ARD, and you’re now facing another, the court must treat this new charge like it’s your first when it comes to punishment. That can mean less jail time, lower fines, and reduced license suspension — at least on the criminal side.
Before this decision, prosecutors in Dauphin County (and across the state) could use your ARD case to push for stiffer penalties the second time around. But the Court said doing so violated your constitutional rights, since ARD isn’t a conviction and doesn’t include the protections of a trial.
What About Your Driver’s License?
Here’s where things get tricky. In a separate case, Ferguson v. PennDOT, the Court said PennDOT can still treat ARD as a prior offense when it comes to suspending your driver’s license. So even though your second DUI might be treated as a first offense in court, the DMV can still come down hard with a longer suspension — as if it were your second DUI.
It’s a complicated situation, and most people don’t realize how quickly things can spiral. If you’re facing DUI charges in Dauphin County, you can’t afford to go it alone. You need a team that knows these rulings inside and out and can guide you through both the criminal and administrative consequences.
