It may seem surprising, but in some situations a push to the upper chest can lead to a strangulation charge in Pennsylvania.

The law defines strangulation as knowingly or intentionally impeding another person’s breathing or blood circulation by applying pressure to the throat or neck.
In practice, however, police officers responding to domestic incidents sometimes interpret contact with the upper chest or collarbone area as possible neck pressure. Because the chest and neck are close together, officers may believe that a push in that region could have affected breathing.
For example, during an argument someone may push another person away to create space. If the contact occurs high on the chest near the collarbone or throat, the alleged victim may later describe it as pressure on the neck.
If officers believe that breathing may have been restricted, they may file a strangulation charge rather than a lesser offense.
These cases often arise during:

- Situations involving mutual pushing
Because strangulation is considered a serious felony offense, prosecutors frequently pursue these cases aggressively once charges are filed.
