Harrisburg responds to gun law challenge; court hearing Friday

The city of Harrisburg has responded to a lawsuit challenging its gun ordinances and attorneys for the city were expected to be in court Friday.

Here’s the gist: Attorneys for the city contend the gun rights group that’s suing over its ordinance can’t show that the ordinance restricts gun ownership.

Meanwhile, The McShane Law Firm plans to argue at Friday’s hearing for a preliminary injunction, which would prevent Harrisburg from enforcing its gun ordinances while its lawsuit against the city is pending, PennLive reports.

A state law passed last year gives the National Rifle Association and similar groups the ability to challenge illegal gun laws. Pittsburgh, Philadelphia and Lancaster have already been targeted for legal challenges by the NRA.

The NRA contends Lancaster’s 2009 lost or stolen reporting ordinance violates a state law that says local governments can’t regulate the lawful ownership, possession, transfer or transportation of guns.

The NRA isn’t suing Harrisburg; instead, a Texas-based group is suing and McShane represents them.

Lancaster hasn’t responded yet to the NRA’s suit, but Mayor Rick Gray has said, as did attorneys for Harrisburg, that its ordinance doesn’t regulate ownership.

Because of the threat of lawsuits, some municipalities have rescinded their local gun ordinance.

Allentown is the latest.

The Morning Call of Allentown reported that the city council on Wednesday voted unanimously to overturn a ban on weapons in parks, reverse a prohibition on weapons on city property and end a requirement that people report when their guns are lost or stolen.
